This website (www.mypetbuddy.com.au)(“Site”) is operated by My Pet Buddy (Australia) (“My Pet Buddy”, “we”, “us”, or “our”), a registered trading name of Gold Flakes Pty Ltd (ABN 93 653 400 821).
The Site allows you to browse, select, and purchase pet care products (“Goods”) for personal use. These Terms of Service (“Terms”) govern your access to and use of the Site and the purchase of Goods from us.
By accessing the Site or placing an order, you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced on this Site.
1. Eligibility & Use of the Site
You must be at least 18 years of age to use this Site, or have the consent of a parent or legal guardian.
You agree to use the Site for lawful purposes only and not to engage in any conduct that breaches applicable Australian or international laws, infringes intellectual property rights, or interferes with the operation or security of the Site.
We reserve the right to suspend or terminate access to the Site where we reasonably believe these Terms have been breached.
2. Online Store & Orders
Our online store is hosted by Shopify Inc., which provides the e-commerce platform used to sell our Goods.
When placing an order, you agree to provide accurate, current, and complete information. An order submitted by you constitutes an offer to purchase Goods at the prices and terms displayed at checkout.
We reserve the right to accept or reject any order at our discretion, including where:
- Goods are unavailable
- There is a pricing or description error.
- We reasonably suspect fraud, unauthorised activity, or resale intent.
Each accepted order forms a separate binding agreement between you and us.
3. Pricing, Payments & Buy Now Pay Later
All prices are displayed in Australian Dollars (AUD) and include GST unless otherwise stated.
We accept payment via Visa, MasterCard, Apple Pay, Google Pay, PayPal, Afterpay, and Zip Pay.
If you choose a Buy Now Pay Later service, you enter into a separate agreement with Afterpay or Zip Pay. My Pet Buddy does not control credit approvals, repayment schedules, fees, or refund processing times applied by these providers.
All applicable charges are shown at checkout, and orders are processed only after successful payment authorisation.
4. Shipping & Delivery
We offer free standard shipping Australia-wide via Australia Post. Express shipping may be available at an additional cost.
Estimated delivery times are provided for guidance only and may vary due to factors outside our control.
We currently ship internationally to selected Commonwealth countries. International customers are responsible for any customs duties, taxes, or import charges.
5. Returns & Refunds
We comply fully with the Australian Consumer Law.
You are entitled to a refund, replacement, or repair if the Goods are faulty, damaged, or not as described.
In addition, we offer a 30-day return period from delivery for eligible returns, subject to the conditions outlined in our Returns Policy.
Refunds are processed to the original payment method. BNPL providers may require additional time to reflect refunded amounts.
6. Order Cancellations
Orders may be cancelled within 6 hours of placement. Once an order has been dispatched, cancellation is no longer possible.
To request a cancellation, please contact support@mypetbuddy.au with your order number.
7. User Content
By submitting reviews, feedback, images, or other content, you grant My Pet Buddy a non-exclusive, royalty-free right to use, reproduce, modify, and publish that content for business and marketing purposes.
You warrant that you own or have permission to submit the content and that it does not infringe third-party rights. We reserve the right to remove content at our discretion.
8. Intellectual Property
All content on this Site, including text, images, branding, logos, designs, and product photography (“Materials”), is owned by or licensed to My Pet Buddy Australia.
You must not reproduce, distribute, modify, or commercially exploit any Materials without our prior written consent.
9. Third-Party Links & Services
The Site may include links to third-party websites or services. We do not control and are not responsible for the content, policies, or practices of those third parties. Use them at your own discretion.
10. Privacy
Personal information is handled in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). Payment data is processed securely in compliance with PCI-DSS standards.
11. Warranties & Limitation of Liability
Nothing in these Terms limits your rights under the Australian Consumer Law.
To the maximum extent permitted by law, we exclude liability for indirect or consequential loss arising from use of the Site or Goods, except where such liability cannot be excluded.
Use of the Site is at your own risk, and we do not warrant that the Site will be uninterrupted or error-free.
12. Indemnity
You agree to indemnify My Pet Buddy against any claims, losses, liabilities, or expenses arising from your breach of these Terms or misuse of the Site.
13. Governing Law
These Terms are governed by the laws of Victoria, Australia, and you submit to the exclusive jurisdiction of Victorian courts.
14. Changes to These Terms
We reserve the right to update these Terms from time to time. The version applicable to your order is the version in effect at the time the order is placed.
Continued use of the Site constitutes acceptance of any updated Terms.
